The relocation of Indonesia’s capital city from Jakarta to Nusantara is still pending a Presidential Decree (Keppres) to be signed by President Prabowo Subianto. Until then, Jakarta remains the capital.
Minister of Home Affairs Tito Karnavian emphasized that Jakarta is still officially the capital of the country. He pointed out that this is stipulated in Law No. 21 of 2023, which amends Law No. 3 of 2022 on the Capital City (IKN).
“The capital is still in Jakarta. There’s a provision in the IKN Law stating that the capital’s relocation from Jakarta to IKN will be determined by a Presidential Regulation. So, once the Keppres or Perpres is ready, it will depend on President Prabowo’s decision on when to issue it,” Tito explained after a working meeting with the Legislative Body (Baleg) of the DPR in Senayan, Jakarta, on Monday (11/18/2024).
Tito stated that the Keppres must be clarified directly with the Ministry of State Secretariat (Kemensetneg). Based on the information he received, the decree awaits the readiness of executive, judicial, and legislative facilities at IKN.
“He (President Prabowo) wants new facilities for the executive branch to be built first. He also wants judicial facilities like the Supreme Court, as well as legislative facilities for the Parliament, Regional Representative Council (DPD), and People’s Consultative Assembly (MPR), creating a comprehensive entity. That’s what he explained,” said Tito.
Thus, according to him, infrastructure readiness is a critical indicator influencing the issuance of the Presidential Decree for the capital’s relocation. It is possible that the relocation will only occur in a few years, once infrastructure is completed.
“Based on his statements, we understand that the relocation requires judicial, executive, and legislative branches to all be present there. That’s why the construction timeline is being pursued,” he added.
Similarly, Minister of Law and Human Rights (Menkumham) Supratman Andi Agtas said the clarification of Jakarta’s status before the Keppres is signed is also outlined in four new provisions inserted into Article 70 of Law No. 2 on the Special Region of Jakarta (DKJ). These provisions include Articles 70A, 70B, 70C, and 70D.
“As of today, Jakarta is still the capital of the Republic of Indonesia. This is stated in Article 70 of the DKJ Law, which declares that the law will only take effect upon the signing of the Keppres related to the capital relocation,” Supratman explained at the same location.
In addition to status, the DKJ Law revisions also await the Keppres. This is a precautionary step ahead of the Jakarta gubernatorial election to avoid any legal void during the transition period.
“If the nomenclature changes after the Keppres, the title should be Governor of the Special Region of Jakarta, right? Similarly, the DPR and DPD members and electoral districts must align. These aspects were overlooked previously, so revisions are necessary to anticipate and prevent legal gaps,” he said.
Meanwhile, the Head of the Nusantara Capital Authority (OIKN), Basuki Hadimuljono, visited the Ministry of National Development Planning (Bappenas) today. During the visit, he reported and sought guidance on IKN programs through 2028.
“I sought direction from the Minister of National Development Planning to complete the judicial, legislative, and residential ecosystems as instructed by President Prabowo,” Basuki told reporters at the Bappenas office in Jakarta on Monday (11/18/2024).
According to the latest records from detikcom, 51 initiators are involved in IKN development, with 16 construction packages showing an average progress of 87%. Private sector developments include the Hotel Nusantara, Telkom smart office, a 5-megawatt IKN solar power plant, and the PSSI training center.
On the other hand, infrastructure progress by the Ministry of Public Works and Housing (PUPR) includes the Garuda Palace at 99.1%, the State Palace and ceremonial grounds at 87.6%, and the Presidential Secretariat Office at 94%. The State Secretariat Office is also 99.1% complete.
“The presidential area is on average over 95% complete,” said OIKN Deputy for Facilities and Infrastructure, Danis Hidayat Sumadilaga, during a working meeting with Commission II of the DPR on Wednesday (10/30).
