Prosecutor Officially Appeals 6.5-Year Sentence for Harvey Moeis: Too Lenient!

Jakarta -Prosecutors at the Attorney General’s Office (Kejagung) filed an appeal against the verdict of businessman Harvey Moeis and others. Because, the prosecutor considers the verdict against Harvey Moeis too lenient.

The Director of Prosecution at the Jampidsus Kejagung, Sutikno, stated that they have filed an appeal against the verdict of the defendants Harvey Moeis, Suwito Gunawan, Robert Indiarto, Reza Andriansyah, and Suparta. The five of them are defendants in the tin commodity corruption case in the Mining Business License (IUP) area of PT Timah Tbk for the years 2015-2022.

Sutikno said the reason the prosecutor filed an appeal was because the sentence given to the five defendants was too lenient. He believes there is a legal imbalance in that verdict.

“(The reason) one, the sentence is too lenient, especially for the physical punishment.” From there, it is apparent that the judge only considered the roles of the perpetrators. “But the judge seems to have not considered or did not consider the impact caused by them on the Bangka Belitung community,” said Sutikno to reporters on Friday (27/12/2024).

Previously, Harvey Moeis was sentenced to prison. Harvey was found guilty in a corruption case involving the joint management of tin commodity trade, causing state losses of IDR 300 trillion.

“To adjudicate, to declare the Defendant Harvey Moeis has been proven legally and convincingly guilty of committing corruption together and committing money laundering,” said Chief Judge Eko Aryanto while reading the verdict at the Central Jakarta Corruption Court, Jalan Bungur Raya, Central Jakarta, Monday (23/12/2024).

“Sentencing the Defendant to 6 years and 6 months in prison,” the judge continued.

In this case, Harvey was sentenced to 12 years in prison.

Besides Harvey, there are also Suwito Gunawan, Suparta, and Robert Indiarto who were sentenced to 8 years in prison, even though the prosecutor’s demand was 14 years in prison. Then Reza Andriansyah was sentenced to 5 years in prison despite the prosecutor’s demand for 8 years.
