Agung Sedayu Explains HGB at Pagar Laut Tangerang: Formerly a Shrimp Farm-Rice Field

Jakarta – Agung Sedayu Group explained the ownership certificate (SHM) and building use rights certificate (SHGB) in the coastal area in Tangerang. They mentioned that the ownership certificates (SHM) and building use rights certificates (SHGB) held by their subsidiary were once land and have now become sea due to erosion.

Agung Sedayu’s legal counsel, Muannas Alaidid, stated that they have checked the certificate application documents issued in 1982, which indicated that the sea wall used to be land. Muannas claims that the land around the coastal fence area in Kohod Village used to be former shrimp ponds or rice fields that had eroded.

“Pay attention to the statement made by the Minister of ATR/BPN Nusron Wahid, who instructed the Director General of SPPN to coordinate and check with the Geospatial Information Agency regarding the coastline of Kohod village, whether the HGB and SHM certificates are within or outside the coastline,” said Muannas in his statement, Thursday (23/1/2025).

“Where’s the problem if the SHGB and SHM were issued for land that originally belonged to residents, which was once a shrimp farm or rice field that had eroded but has not been destroyed because its boundaries are still known in a fenced position and have since been converted to SHGB PT,” he added.

Then, Muannas mentioned that the land around the sea fence also has SHM owned by other residents. He claims that the land was purchased from the people.

“Then match it with Google Earth where the SHGB and SHM are fenced around the bamboo fence, all clearly showing that it is not the sea that is certified, but the land of the residents that has eroded and then been transferred to become SHGB PT and some SHM, among which belong to the residents who are being questioned today,” he said.

This issue was then brought to the sea fence, stating that all sea fences along 30 km are SHGB PIK. That is not true because there are other land certificates according to the BPN’s statement. That the SHGBs mentioned above were all issued in accordance with the proper processes and procedures. We bought it from the people, originally SHM, and officially changed the name, paid the taxes, and there is an SK location permit/PKKPR, all complete,” he added.

ATR/BPN Investigation

The Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), Nusron Wahid, stated that the ATR/BPN Ministry is currently conducting an investigation regarding the matter. He revealed this during the PTSL Hall in Jakarta today.

The Ministry of ATR/BPN has dispatched the Director General of Land and Space Surveying and Mapping (SPPR), Mr. Virgo, to coordinate with the Geospatial Information Agency (BIG) regarding the coastline of the Kohod Village area. This step aims to ensure whether the plots of land are located within or outside the coastline. Data on certificate application documents issued since 1982 will be compared with the latest coastline data up to 2024,” said Nusron in a written statement on Monday (20/1).

Nevertheless, Nusron has conducted an initial investigation that in that location, 263 plots have been issued, consisting of 234 Building Use Rights Certificates (SHGB) in the name of PT Intan Agung Makmur, 20 SHGB in the name of PT Cahaya Inti Sentosa, and 9 plots in the name of individuals. In addition, 17 fields of Ownership Certificates were found in the area.

He stated that if the results of the coordination check show that the issued certificates are located beyond the coastline, an evaluation and review will be conducted.
